Acceptance of Terms and Conditions
The receipt of your deposit by The Traveling Twiga for yourself and others you are depositing for will constitute your and their understanding and acceptance of these Terms and Conditions.
Reservations and Payments
A non-refundable deposit of $250 is required to confirm your reservation and must be accompanied by the completed Reservation Form. The balance of the trip cost is due no later than 90 days prior to departure along with the Travel Insurance Acceptance Form for each traveler. We accept personal checks, cashiers checks, PayPal and wire transfers.
All payments will be held in a trust account, from which your trip payments will be made.
Cancellations and Refunds
Cancellations received in writing by the Traveling Twiga 90 days or more prior to departure incur a cancellation fee of $250. Cancellations received 89-61 days prior to departure incur a penalty of 50% of the tour price. Cancellations received 60 days or less prior to departure will cause a forfeiture of 100% of the tour price. Trip insurance is highly recommended to cover any eligible unforeseen circumstance requiring cancellation. There will be no refunds for any unused portions of the tour.
Trip Insurance
Travel insurance is strongly recommended. It is the sole responsibility of each traveler to ascertain that they carry appropriate comprehensive travel and medical insurance, which should include, but not be limited to, emergency evacuation, medical expenses, cancellation of the trip, theft, loss or damage of the belongings. The Traveling Twiga shall not be responsible for any costs or losses incurred by the traveler during the trip.
Medical Information and Health
We recommend consulting your physician for any precautions that may be appropriate for you. Additionally, the Centers of Disease Control (CDC) website may have useful information regarding updated vaccination recommendations for different countries that change from time to time (www.cdc.gov). Participation on a safari tour, like any long trip, requires that you are in generally good health. It is important that persons with medical conditions and/or dietary restrictions inform the Traveling Twiga of any such condition well before departure. Anti-malaria precautions should be taken and this is the sole responsibility of the tour participant. Please carry your vaccination record with you, as well as your important medications. The Traveling Twiga will not assume any responsibility for the accuracy of any medical information. A Medical Authorization Form must be completed and sent to the Traveling Twiga prior to the departure.
Airfares and Delays
Airfares may change without notice prior to ticketing. The Traveling Twiga is not responsible for any airline schedule or fee changes, cancellations, delays, damage or loss of luggage. Any claims of such loss must be made directly with the airline. Changes in airline schedules may necessitate additional nights to be added to your tour. The Traveling Twiga is not responsible for any costs associated with airlines not adhering to the purchased schedule, as that is beyond the control of the Traveling Twiga.
Tour Cancellation
The Traveling Twiga shall not be held liable for any circumstance beyond its control, such as strikes, wars, acts of God or any such circumstance that make operating the tour not advisable, impossible or even illegal. In such case all payments paid to the Traveling Twiga will be promptly refunded. This refund is the extent of the Traveling Twiga’s liability.
Itinerary Changes
Although every effort is made to complete each tour as planned, occasionally conditions beyond our control necessitate changing the itinerary and substituting a route, lodging or in-country air schedule with a reasonable alternative. Such change may be caused by seasonal rainfall affecting the roads, air strips or overbooking in lodges, game migration from one area to another etc. The Traveling Twiga shall not be held responsible for such changes beyond its control and no refund will be due.
If a client requests a last minute change in the itinerary, this client will be responsible for any additional fees that the change may incur. These fees will be payable at the time of the request.
Specific accommodation
We will use every effort to ensure that the reserved accommodation is available as planned. However, in case of overbooking or other unavailability, a reasonable alternative will be used. The Traveling Twiga will not be held responsible for a refund either in whole or part.
Wild animals
Our safaris may take you to close proximity of wild animals. Attacks on humans are extremely rare; however, no safari into the African wild can guarantee that this will not occur. It is imperative to follow the safety instructions of your guide and the lodge staff when on game drives and when moving about the lodge grounds. Please note that many lodge or camp grounds are not fenced and wildlife can move freely in and around these areas. The Traveling Twiga shall not be held responsible for any incident or injury on the tour.
Travel Documents
It is the responsibility of the traveler to ensure that a passport and visa are valid and in effect at least until six months after the planned return date. Please carry your vaccination record with you. It is your responsibility to report to all travel arrangements on time and carry your travel documents with you. The Traveling Twiga will not be responsible for any potential costs incurred if you fail to do so.
Increase in Costs
The quoted price of the tour is based on current rates and is subject to change if there are any increases in national park fees, internal airfares, airport taxes, lodging rates, governmental fees and taxes, third party fees or any other circumstance beyond our control. You will be informed of such change promptly and charged accordingly.
Representation and Consent
The person making a booking with The Traveling Twiga warrants that he/she has authority to enter into this agreement on behalf of all other persons in the same booking. In the event of the failure of any or all of the other persons included to make payment, the person making the booking shall by his/her signature assume personal liability for the total price of all bookings made by him/her.
The payment of the deposit or any partial payment for a reservation constitutes consent by all travelers covered by that payment to all provisions of the Terms and Conditions contained in this agreement whether the traveler has signed the Reservation Form or not. The Terms, under which you agree to take these tours, cannot be changed or amended except in writing by The Traveling Twiga.
Responsibility
The Traveling Twiga shall not be held responsible for any actions or failure to act of third parties not included in this agreement such as entities that provide services or goods including but not limited to lodging facilities, meal and beverage providers, transportation companies and safari operators. A Liability Waiver form must be signed and sent to The Traveling Twiga prior to the departure.
Entire Agreement
This contract contains all of the agreements between the parties regarding the subject of this contract. Each party acknowledges that no representation, promises or agreements have been made by or on behalf of any party except for the agreements contained in this contract. No agreement, statement or promise not contained in this contract shall be valid or binding regarding the subject of this contract.
Arbitration Agreement
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in Harris County, Texas. The arbitration shall be conducted on a confidential basis pursuant to the then current Commercial Arbitration Rules of the American Arbitration Association. Any such arbitration shall be conducted by an arbitrator experienced in travel law and shall include a written record of the arbitration hearing. The parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. In any such arbitration, the substantive law of Texas will apply.
Being a Texas based agency, The Traveling Twiga is not a participant in the California Restitution Fund.
